Why Cook Islands
The Cook Islands Asset Protection Trust (APT) is widely regarded as the most protective trust structure available. Its legislation is specifically designed to defeat foreign judgments, prevent fraudulent transfer claims, and provide settlors with maximum control while maintaining asset protection.
Why Cook Islands
Cook Islands trust law requires creditors to prove beyond a reasonable doubt (criminal standard) that the transfer was fraudulent, an almost impossible burden. Foreign judgments are not recognized, and the statute of limitations is one to two years from the date of transfer. No other jurisdiction offers this level of protection.
How Protection Works
Assets transferred to the trust are managed by a Cook Islands-licensed trustee. The settlor may retain a degree of control through a trust protector and letter of wishes. In the event of a lawsuit or creditor claim, the trustee can exercise discretion to protect assets, including invoking "flee clauses" to move the trust to another jurisdiction if necessary.
